Intro: If a reseller is selling your genuine products on Amazon.ae, you almost certainly cannot get them removed this week. Amazon does not treat genuine resale as a policy breach, and UAE trademark law lets in goods you yourself sold in India. That is the bad news. The good news is that you have eight real moves, most of them cheap, and one of them, a registered UAE commercial agent, is the only tool in UAE law that can actually stop their stock at customs. This is the step-by-step plan, in the order we would run it. If you are still working out what is happening and whether it is legal, start with our FAQ on unauthorised sellers and how Amazon arbitrage works, then come back here.

What works against a genuine reseller, and what does not

Before the steps, here is the honest scorecard. Most of the tools brands reach for first were built for counterfeits, not for someone selling your real stock.

Amazon will help you fight a fake. Against your own genuine stock, the levers are your trademark, your supply chain, your product and your contracts.

Step 1: Collect the evidence that actually helps

You need to know who the seller is and where their stock comes from. A test buy is the start, not the whole job.

  • Download the Amazon.ae invoice for your test order. It should show the seller's legal business name, address and UAE VAT number (TRN) if they are registered. The storefront name alone usually tells you nothing.
  • Search the Amazon barcode label (the FNSKU, starting with X00) in your own Amazon.in inventory. A match means the unit left your own Amazon stock. No match means it is the reseller's own label.
  • Read the carton. A blacked-out or peeled MRP sticker means Indian retail stock with the rupee price hidden on purpose. Missing batch codes mean you cannot trace which sale it came from, which is a gap to fix in Step 4.
  • Screenshot the seller profile with the date, including any business details shown.
  • Test-buy one or two other ASINs from the same seller to see whether the pattern repeats across your range.
  • Pull your Amazon.in order reports for the resold products and look for multi-unit orders, repeat PIN codes and business orders with a GSTIN.

Step 2: File your UAE trademark this week

Everything else on this list depends on this one. The UAE gives trademark rights to the first person to apply, not the first person to use the mark, according to this 2026 UAE trademark guide. If you have no UAE filing, you have no UAE rights, and in theory the reseller could file your brand name before you do. File before you contact them.

  • Cost: only about AED 750 per class is due at filing, per this UAE fee schedule summary. Total government fees land somewhere between about AED 5,250 and AED 6,500 per class depending on the source, plus your agent's fee. At roughly ₹23 to the dirham, that is about ₹1.2 to 1.5 lakh per class.
  • Time: about 3 to 6 months on the standard route, or 6 to 10 weeks on the fast track, with a 30-day opposition window after publication.
  • Route: file directly with the UAE Ministry of Economy, or extend your Indian mark to the UAE through the Madrid System. The Madrid route is tied to your Indian registration for its first five years, so a problem with the Indian mark can affect the UAE one.
  • What to file: the same mark you have registered in India (word mark, logo, or both) in the right class. Kitchenware, for example, usually sits in Class 21. Confirm the classes with your filing agent.

Step 3: Get Brand Registry on Amazon.ae

Brand Registry will not remove a genuine reseller. What it gives you is control of how your brand shows up on Amazon.ae, and the tools to pull shoppers towards your own listings: A+ content, a Brand Store, Sponsored Brands and Display ads, Brand Analytics and the Brand Referral Bonus, as Amazon's UAE Brand Registry page sets out.

You need a trademark that covers the UAE. Sources disagree on whether a pending UAE application is enough or Amazon.ae wants an active registration, so expect to apply as soon as your filing qualifies and be ready to wait for registration. Your Indian Brand Registry enrolment does not automatically cover Amazon.ae.

Step 4: Cut off their supply in India

A cross-border reseller lives on cheap, easy supply. Make it expensive and slow.

  • Set a maximum order quantity on the resold products on Amazon.in. Determined buyers can split orders or use extra accounts, so this adds friction rather than a wall.
  • Turn off Business pricing on those products, and use Amazon Business order data: business invoices show the buyer's business name, GSTIN and PO number, which can identify a reseller buying as a company.
  • Make sale discounts shallower on the products they resell. Their buying price is your sale price, so your deepest discounts are exactly when they stock up.
  • Add channel batch codes to your cartons, so the next test buy tells you which channel, distributor or sale the unit came from.
  • Add no-export and territory clauses to your distributor agreements. Under India's Competition Act these count as exclusive distribution under section 3(4) and are only a problem if they cause an appreciable adverse effect on competition, so the risk for a small brand is low, according to this 2025 analysis. Do not dictate your distributors' resale prices: resale price maintenance is what got Maruti Suzuki fined ₹200 crore.

Two things that look like supply controls but are not: Amazon gives sellers no way to block a buyer, and you cannot cancel FBA orders. Cancelling your own self-shipped orders counts against your account and now carries a fee.

Step 5: Offer to make them your distributor

This is often the fastest and cheapest fix. A seller who has already worked out Amazon.ae listings, FBA and UAE customs for your products is doing something you have not done yet. Conversion makes most sense when the seller is genuine, professional and covers a market you do not serve, which describes most cross-border resellers, as Red Points notes.

  • Offer a wholesale price below what they pay on Amazon.in. They get better margin and a reliable supply. You get control.
  • Put it in writing. Typical terms, drawn from authorised reseller templates brands use: approved storefronts and ASINs only, buying only from you, quality and service standards, monthly sales reporting, a territory limit, and rebates tied to sell-through.
  • Keep it non-exclusive, fixed-term and unregistered. In the UAE a registered exclusive agency gives the agent strong statutory rights over you (Step 8), so keep this deal deliberately lighter than that, as CMS explains. Have a lawyer draft any pricing terms.
  • File your trademark first (Step 2), so your new partner cannot register your mark.

Buying out their current stock only clears what they hold today. If they have a lot of it, that is a sign your supply leak is bigger than one sale.

Step 6: Launch your own Amazon.ae store and price with your cost advantage

If they say no, sell on the same listings yourself. You have a structural advantage: they pay your Amazon.in retail price for every unit, while you pay your manufacturing cost. Freight, UAE duty and Amazon fees are roughly the same for both of you, so the gap between your break-even and theirs is roughly your Amazon.in price minus your making cost.

  • Match their price, do not undercut it. You do not need a price war to win orders; you need to be a credible seller on the same listing, with stock in a UAE fulfilment centre. Sponsored Products ads only run while you hold the Featured Offer, so pricing and stock levels decide whether your ad budget works at all.
  • You can sell from India without a UAE company through Amazon Global Selling, though your stock still needs a UAE importer of record. Our guide to selling on Amazon.ae from India compares that route with setting up a UAE entity, and this one covers importers of record and customs duty.
  • Run the numbers per product before you list. Model referral and FBA fees with our Amazon.ae fee breakdown, and claim zero duty under India–UAE CEPA where your goods qualify.
  • Your own launch must be compliant, even if theirs is not. UAE rules require Arabic consumer information, importer details and AED prices, and some categories need extra certification. Food-contact items, for instance, need migration test reports to clear Dubai customs.

Step 7: Create a UAE-only version of your product

A product with real physical differences needs its own barcode, and a new barcode gets a new ASIN. Indian retail units cannot be sold on that new listing, so the reseller is shut out of it, as Amazon staff have explained on its seller forum. Market-specific products and barcodes are a common brand-protection tactic, as this guide to parallel imports on Amazon notes.

  • The difference has to be real: a different set, size, accessory, model or bundle. New labels alone do not count.
  • Add a UAE warranty that only covers the UAE version. Nikon USA, for example, refuses warranty service on grey-market imports.
  • Point all your Brand Registry tools at it: A+ content, your Brand Store and Sponsored Brands ads.
  • Expect to start from zero reviews, because reviews do not carry over to a new ASIN. The reseller keeps the old listings.

A genuinely different UAE version may also support a "materially different goods" argument later, which is a question for your lawyer.

Step 8: The only route that can block their imports: a registered UAE agent

If you want the reseller's stock stopped, this is the tool. Under Article 20 of the UAE Commercial Agencies Law (Federal Law 3 of 2022), goods covered by a registered commercial agency may not be imported for trading by anyone other than the agent, and customs may not release other people's imports. At the agent's request, the Ministry can have shipments held while a dispute is decided.

It is powerful, and it cuts both ways. Read these before you sign anything:

  • Who can be your agent: UAE nationals or companies wholly owned by them (Article 2). Your own UAE company generally cannot be the agent unless the Cabinet approves it, which is not straightforward, according to Pinsent Masons. Setting up your own UAE company lets you import in your own name, but it does not on its own give you the power to block anyone.
  • The agency is exclusive for its territory (Article 7), and the agent earns commission on deals in that territory, including your own (Article 8).
  • It is hard to exit. The agent can claim compensation when the contract ends (Article 11), and a registered agent can even block your own imports, as Hadef & Partners explains.
  • Cost and speed: registration costs AED 7,500 and renewal AED 3,000 a year, and the Ministry decides within 10 working days, per the Ministry of Economy. You need the UAE trademark first.
  • Penalties exist, with fines under Cabinet Decision 89/2023 rising from a warning to AED 100,000, then AED 200,000 plus seizure, then AED 400,000 plus closure for sales by anyone other than the agent. Whether those reach third-party marketplace sellers is unclear.
  • It is untested against Amazon resellers. We found no public case of an agency being used against an Amazon.ae seller, though FBA stock does clear customs like any other import, so in principle Article 20 could apply.

Customs recordal is the other tool you will hear about. Once your mark is registered, you can record it with customs in each of the seven emirates, each on its own system. A 2026 analysis by a Dubai firm calls recordal "often the most effective practical mechanism against parallel imports", but Article 46(2) of the UAE Trademarks Law exempts goods you sold in the exporting country, so ask your lawyer how customs applies it in practice.

What not to do

  • Do not file a counterfeit or IP report on genuine goods. It is a false report. Abusive reporting gets brand accounts suspended, and Amazon has sued people over false infringement notices.
  • Do not pay for "remove any hijacker in 24 hours" services. If the goods are genuine, the only way to do that is a false complaint, and it is your account on the line.
  • Do not cancel orders to target suspected resellers. It hurts your account metrics, not theirs.
  • Do not count on a compliance complaint. A reseller can usually fix labelling gaps with a sticker, and we found no UAE evidence of compliance complaints being used to remove parallel importers.

Questions to take to a UAE IP lawyer

One paid opinion from UAE counsel should tell you whether you can block the reseller or should convert or out-compete them. Bring your test-buy photos, the seller profile and these questions:

  1. Given Article 46(2), can customs recordal stop my genuine Indian-origin goods in practice?
  2. Would a registered exclusive agent under Article 20 stop the reseller's FBA imports, and is my product category exempt from agency rules?
  3. Can my own company or an affiliate act as the agent, and how hard is Cabinet approval?
  4. How can the agency contract limit commission on my own sales, blocking of my imports, and compensation at the end?
  5. Would a materially different UAE version with its own warranty support a trademark or unfair competition claim?
  6. How should a distributor deal be drafted so it is not treated as a commercial agency?
  7. Direct national filing or a Madrid designation, which classes, and is fast track worth it?

Your 90-day plan

WhenDo this
This weekFile the UAE trademark. Book a UAE IP lawyer. Download the test-buy invoice, screenshot the seller profile, search the FNSKU in your Amazon.in inventory, pull order reports for bulk and business buyers.
This monthOffer the reseller a distributor deal (after filing). Set maximum order quantities, turn off Business pricing and plan shallower discounts on resold products. Add batch codes and no-export clauses. Choose how you will sell on Amazon.ae and line up an importer of record.
Next three monthsDesign and test a UAE-only version. Enrol in Brand Registry on Amazon.ae and build your Store, A+ and ads around your own listings. When the mark registers, record it with customs and decide on a registered agent with your lawyer.

Stopping an unauthorised seller on Amazon.ae: quick answers

Can I get an unauthorised seller removed from Amazon.ae?

Not if they sell your genuine, unaltered products. Amazon does not treat that as a policy breach. Your levers are a UAE trademark, Brand Registry, cutting their supply, converting them into a distributor, a UAE-only product version, and in the strongest case a registered UAE commercial agent.

Can a UAE distributor stop other people importing my products?

A registered exclusive commercial agent can: Article 20 of Federal Law 3 of 2022 bars others from importing the agent's goods for trading. The agent must generally be a UAE national or a company they wholly own, the agency is exclusive, and it is hard to end, so take legal advice first.

Should I make the reseller my distributor?

Often, yes. It is the fastest and cheapest way to turn a problem into a controlled channel. File your UAE trademark first, and keep the deal non-exclusive, fixed-term and unregistered so it is not treated as a commercial agency.

Should I undercut the reseller's price on Amazon.ae?

Usually not. They pay your Amazon.in retail price; you pay your making cost. Matching their price on the same listing keeps your margin and lets you compete for the Featured Offer without a price war.

Does Amazon Transparency stop resellers?

Not resellers of genuine stock. Transparency blocks units without valid codes, and your genuine units carry valid codes wherever they end up.

This article is general information, not legal advice. UAE commercial agency and trademark questions in particular depend on your facts, so confirm your plan with a UAE IP lawyer before acting.
